THC-B: Where Is It Legal? State By State List

First things first: THC-B is, in fact, federally legal.  This is because of the 2018 Farm Bill that determined that all hemp derivatives may be sold legally as long as they are proven to contain no more than 0.3% delta 9 THC by dry weight.  Tetrahydrocannabutol (THC-B) is not delta 9 THC, and so it’s completely legal. 

Federal law has no restrictions when it comes to the types of THC-B products that may be sold, how many milligrams of the cannabinoid they may contain, how much a person may purchase at any given time, or how much a person may possess.  Federal law doesn’t even have an age limit when it comes to buying hemp derivatives.

While THC-B is a federally permitted cannabinoid, that doesn’t mean that it’s available in all 50 states.  When delta 8 THC first hit the market a couple of years ago, a number of states changed their hemp laws to ban psychoactive cannabinoids.  This means that while THC-B has not been explicitly banned in any state, as it’s too new to even impact legislation, it’s almost certainly illegal in states in which delta 8 is banned, based on the specifics of the law.

Very important to point out, that while these laws are the most current according to state, they are subject to change.  Some states are in the process of reviewing their laws on psychoactive cannabinoids as we speak, in fact. 

What this ultimately means is that this list is current, but in a couple of months another state may end up banning these cannabinoids.  So, your best bet is to periodically check to see whether or not your state has changed its laws, effectively making THC-B illegal where you reside.

Naturally, no one wants to accidentally get into trouble with the law because they wanted to try THC-B.  Here are some tips for making sure that every aspect of your THC-B experience is compliant with the law.

#1: Make Sure Your State Allows It

We need to emphasize again that state laws regarding hemp-derived psychoactives can change.  Hemp laws are extremely new, and many states are adjusting them as the industry evolves.  So, once again, make sure that THC-B remains legal in your state in the coming months as you begin to purchase the cannabinoid from Binoid.

#2: Ensure It’s Hemp-Derived

#4: Be Mindful Of Where And When You Use It

Keep in mind that even if THC-B is legal in your state, there may be laws restricting where you can use certain products.  Any THC-B product that is vaped or smoked is illegal to use in places where vaping and smoking are generally prohibited, such as most indoor public spaces.

Can THC-B Result In A Failed Drug Test?

Now, let’s get back into the practicalities regarding THC-B.  One question that we’ve been getting ever since CBD hit the scene is whether or not hemp can cause you to fail a drug test.  Well, here’s where it gets interesting.  Hemp as a whole, in the form of flower or full spectrum hemp, will not usually cause a failed drug test. 

This is because the amount of THC-B, including both delta 8, delta 9, and other Delta’s is so low in hemp that it won’t even register. However, THC-B may be a different story, and it is possible THC-B products will trigger a drug test. That we know. 

However, the interesting thing about THC-B is that it is not Delta 9 THC, and is therefore should not show up on a Delta 9 drug test. The FDA’s Role In THC-B

Presently, the FDA has not yet regulated hemp products, even though they are legal.  What this means is that there could come a time when the FDA creates its own guidelines on FDA that are technically not part of state or federal law.  At the moment, hemp products are sold in an unregulated market, which means that companies can essentially do whatever they want when producing hemp-based goods.

Tetrahydrocannabutol (THC-B) is a homologue of delta 9 THC. Plainly speaking, this cannabinoid structure is a long chain, and the longer the chain the more potent and effective the compound is. Also has been determined how THC-B works on CB1 receptors on a stronger level than delta 9 THC.  Keep in mind, too, it’s the CB1 receptors in the brain that trigger the psychoactive effect for which we experience from those THC-based cannabinoids in general.

What’s unique about this process is that it’s also much more “sound” in terms of its legality.  CBD is known to be a largely safe substance, and by using molecular chemistry to turn it into THC-B you’re helping to break the association to delta 9 THC. 

Can THC-B Be Discovered On A Lab Test By Law Enforcement?

Another concern that many have is that THC-B may be read if analyzed by a lab.  Let’s say a cop pulls you over and discovers your THC-B vape oil.  Then, they confiscate it and test it to see whether or not it’s legal.  Again as stated before, because THC-B and THC-B products are not Delta 9 THC products, that means it will likely not spike anything on a drug test.
