Can THC-P Be Shipped To All 50 States?

The most notable characteristic of tetrahydrocannabiphorol (THC-P) is, to nobody’s surprise, its psychoactive activity, as this is always the aspect of a THC cannabinoid that gets the most interest.  So, what is the psychoactive nature of THC-P and THC-P Products?  Well, researchers found that THC-P is 30x more efficient when it comes to binding to CB1 receptors than delta-9-tetrahydrocannabinol (delta 9 THC).

When it comes to the hemp market in the United States, laws have changed quite a bit since 2018, when the hemp plant was first legalized according to the passing of the Farm Bill, which stated that all products made with a maximum of 0.3% delta 9 THC could be sold legally.  

At the time, lawmakers couldn’t foresee the growing number of psychoactive cannabinoids that would be derived from the hemp plant, while being different from delta 9 THC, and therefore technically being considered legal.

Given the sometimes confusing legal landscape of the hemp market and the cannabis industry as a whole, we want to confirm whether or not THC-P products can, legally, be shipped across the US.

Does Federal Law Allow THC-P Products to Be Shipped Across States?

First off, let’s cover federal law.  Again, the law is clear that THC-P hemp products may be sold legally, but how does that apply to shipping?  Well, federal law does not restrict the shipment of hemp products that comply with federal restrictions.  In other words, as long as the product is compliant with the law stating that a hemp product may not contain more than 0.3% delta 9 THC, it can be shipped across state lines.

However, in order for this to be legal, the product must adhere to two standards:

• The hemp product must have undergone third-party testing by a state-licensed laboratory, for purity, safety, and legal compliance.  The lab reports must be included with the THC-P product.
• The shipper must provide proof of licensing to produce and/or distribute hemp-derived products, in order to be permitted to ship it to another state.

Another thing to be aware of is that as of late 2023, vaping THC-P products, including those that contain hemp vape oils, can only be received by the customer via mail if they are 21 years of age or older (they must provide an ID), and if they sign for the product at the time of its arrival.  This applies to all 50 states.

Do States Allow THC-P Products to Be Shipped?

Now, let’s see whether or not certain states restrict the shipment of THC-P products, in particular.

• Alabama: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Alaska: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Arizona: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Arkansas: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• California: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Colorado: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Connecticut: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Delaware: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Florida: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Georgia: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Hawaii: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Idaho: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Illinois: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Indiana: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Iowa: THC-P products may not be shipped in and out of the state, as THC-P is strictly prohibited in the state, and therefore no products may be sold under any circumstances.
• Kansas: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
• Kentucky: THC-P products may be shipped in and out of the state without any restrictions based on amount, concentration of THC-P per product, or product type.
